This website is operated by DPlay Entertainment Limited ("we" or "us").
DPlay Entertainment Limited is a limited liability company registered in England and Wales under company registration number 09615785 and whose registered office is at Chiswick Park Building 2, 566 Chiswick High Road, London, W4 5YB, United Kingdom.
- GENERAL TERMS AND CONDITIONS
- These Terms and Conditions (“Terms”) govern your access to, and participation in the Voice Panel (the "Panel"). Participants in the Panel are called "Members".
- The Panel is accessible via the websites uk.eurosportvoice.com, fr.eurosportvoice.com, de.eurosportvoice.com and www.tntsportsvoice.com which may contain editorial, audio, and video, multimedia, as well as additional data, content and services for registered users (the “Website”). The Website may be suspended or discontinued at any time.
- Your access to and use of the Website and participation in the Panel is conditional on your acceptance of and compliance with these Terms. By accessing or using the Website and participating in the Panel, you unconditionally agree to be bound by these Terms.
- We may revise these Terms and the Panel from time to time, at our sole discretion, provided that such changes are reasonable. You should review the most current version of these Terms each time you choose to use the Website and participate in the Panel, by clicking on the dedicated link. If you disagree with the revised Terms, you are free to refrain from accessing and using the Website and participating in the Panel.
- Specific terms and conditions may apply to certain features and functionalities available on the Website or other services operated by us, such as, but without limitation, pay-to-use services or competitions. In these cases, the specific terms and conditions are supplementary to, and do not exclude the application of, these Terms.
- You acknowledge that any personal information you supply to us or that we collect from you when using the Website will be used by us in the ways set out in our [].
- You must be 18 years old or over and a resident in France, Germany or the United Kingdom in order to participate in the Panel. We reserve the right to ask you to prove that you are eligible to participate and disqualify from you from the Panel if you are deemed to be ineligible.
- Our employees, their immediate family, those living their same households (whether related or not related) or any third party associated with us are not eligible to participate in the Panel.
- HOW THE PANEL WORKS
- The purpose of the Panel is to collect opinions and suggestions from Members about our services via regular online surveys (the “Survey(s)”).
- You can earn points for taking part in Surveys, which are exchangeable for online retail vouchers (please see Section 3 for more details).
- In order to take part in the Panel and earn points, each Member must register on the Website by completing the online registration form.
- We recommend that you keep your username and password safe and do not share them with anyone. You are solely responsible for your password and agree to notify us without delay if you become aware of or suspect any breach of security or unauthorised use of your password or other Panel registration credentials.
- You represent and warrant that all information you provide to us when you register for the Panel (and at all other times) will be true, accurate, up to date and complete, and that you will not attempt to register for the Panel under the name of or log into the account of another person at any time. You shall not be eligible to participate in the Panel or earn points for any Surveys where your Survey or Quick Poll entries or your personal details are inaccurate or incomplete.
- Once you have correctly filled in and submitted the Panel registration form and your registration has been confirmed by us, you will be able to participate in the Surveys by logging in with your username and password and clicking on the Surveys that are available on the Website. You may also receive invitations to complete Surveys via email from time to time.
- You will be notified via email whenever a new Survey becomes available to complete. You can also find new Surveys that are available to complete logging into your account via the Website. Surveys may only be available for a limited period of time and you must complete the Survey within the allotted time period in order earn points for that Survey.
- You are only permitted to enter each Survey or Quick Poll (as defined below) once. Multiple entries made by the same person will not be valid and may result in your disqualification from the Panel.
- Any entries which do not comply with these Terms, or which contain any third party intellectual property without prior informed consent from the rights holder, or which violates or infringes another’s rights, including but not limited to privacy, publicity, or which contain any abusive, inappropriate, offensive or obscene language or imagery will be disqualified. Examples of language/images considered to be inappropriate, offensive or obscene, include (but are not limited to) any message/image which contains: (a) swearing; (b) comments or actions which appear to be discriminatory of any person, company or group of individuals, for example comments of a racist, sexist or homophobic nature; (c) comments or actions which promote bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age (d) sexual innuendo, sexual language or sexual acts, actions or gestures; (e) promoting any illegal unlawful activity such as drug use; and (f) content which is tortious, defamatory, slanderous or libellous.
- We reserve the right, at any time and without prior notice, to deactivate the account or the access rights of any person who breaches these Terms or who no longer has permission to access the Website or participate in the Panel.
- HOW THE POINTS WORK
Earning points
- Members earn points by taking part in Surveys . You can exchange your points for vouchers that can be redeemed with certain online retailers we tell you about from time to time.
- Each new Member will receive 100 points when they first sign up to participate in the Panel.
- Members earn 100 points per Survey completed in accordance with these Terms.
- In addition to earning points for the completion of Surveys, Members can also earn 10 points for each 'Quick Poll' (being a single-question survey) that you complete.
Using points
- Members can exchange their points for online retail vouchers once they have earned 800 points. You can exchange your points and redeem your retail voucher at any time by following the instructions on the Website in the ‘Rewards’ section. Please note that third party terms and conditions may apply to your use of such vouchers and it is your responsibility to make sure that you read and understand them.
- Your points will remain valid for as long as you are a Member. Once you redeem your points in exchange for a voucher and an order for the voucher has been placed, the corresponding points will automatically be deducted from your account. You will receive your voucher code via the email address that you provided when you registered to participate in the Panel.
- Vouchers are not transferable and there are no alternative vouchers or cash substitutes unless otherwise agreed by us. We reserve the right to substitute a voucher of equal or greater value in the event that the selected voucher is unavailable for any reason whatsoever.
- We reserve the right to terminate the Panel upon giving Members 3 months' notice, unless we need to terminate the Panel sooner for reasons outside of our control. You can no longer redeem your points once the Panel is terminated and any unused points at the date of termination will be cancelled without compensation to you.
- OUR CONTENT AND INTELLECTUAL PROPERTY
- The content we make available to you on or through our Website or via the Panel (including any Quick Polls, Surveys and any other associated communications) belongs to us and/or our licensors and is protected by intellectual property rights under applicable laws, treaties and conventions around the word. All such rights are reserved and you therefore have no intellectual property rights in, or to, any part of this offering, other than the right to use it in accordance with these Terms.
- You are not allowed to reproduce, copy, sell, modify, re-edit, communicate, distribute or use, in any way whatsoever, any content on or from the Website or the Panel (including, but not limited to, logos, service marks, trademarks, trade names, photographs, illustrations, videos, articles and associated code and software), in whole or in part, otherwise than as provided for in these Terms, without our express prior written consent.
- You may view and use the Panel and the Website (and content on the Website) for your own personal, and non-commercial use only.
- We accept redirect links to the Website, but reserve the right to require their deletion if necessary.
- You may not frame any of the content of the Website or the Panel, or incorporate into another website, application, online service or audiovisual service any of the content featured within the Website or the Panel, whether owned by us or our partners.
- You may privately share certain content by using the share features available via the Website and the Panel.
- No other use is permitted without our express prior written consent.
- WHAT WE ARE RESPONSIBLE FOR
- You have certain legal rights under the laws of your territory. Nothing in these Terms is intended to affect these legal rights and we do not exclude our liability where we are not permitted to do so under the laws of your territory.
- Given the international nature of the internet, we remind you that you must comply with all mandatory and public policy rules which apply in your country of residence.
- You acknowledge and agree that your use of the Website and participation in the Panel, including all materials and information obtained via the Website or any communications to you regarding the Panel (including the provision of vouchers), is at your own risk, and, unless caused by our negligence or own breach, we are not responsible for and do not make any promises in relation to:
- any use by you of the Website or participation in the Panel which isn’t authorised by us under these Terms, including loss of profits if you attempt to use or display the Website or any aspect of the Panel for any commercial purpose;
- any failure, malfunction or interruption to the Website, your participation in the Panel, or your redemption or use of third party vouchers due to circumstances outside of our control that prevent us from providing the Website or the Panel, or that can be considered a "force majeure event" under local law (where applicable). This could be due to things such as lightning, flood, severe weather, fire, explosion, terrorist activities, epidemic, pandemic, riots, war, anything done by a government or other public authority, or strikes or other industrial action;
- any lack of functionality or failure to provide any part of the Website, the Panel or any associated content (including Surveys and Quick Polls), or any loss of content or data that is due to malfunctions or faults in your chosen equipment, devices, operating system or internet connection (including malware, viruses or bugs originating from third parties or on any of your devices);
- any replacement of third party vouchers that you have lost;
- your failure to receive an email containing a voucher because you have provided the wrong email address, or due to any total or partial malfunctions of the internet that may have given rise to failures in administration, security, input, integrity, or management of the Panel or that delay or hinder the execution of our or your Panel obligations. In particular, we are not responsible for any error, omission, imperfection, interruption, deletion, transmission delay, failure of communication and connection circuits, destruction, damage, or technical failure of the fixed or mobile terminal of the Member, or for any other problem relating to telecommunications networks to on-line mobile terminals and computers, or to servers or access providers.
- NO RELIANCE ON INFORMATION
- The content on our Website, in the Surveys or other communications provided to you in relation to the Panel is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of such content.
- Although we make reasonable efforts to update the information on our Website and other communications provided to you via or in relation to the Panel, we make no representations, warranties or guarantees, whether express or implied, that the content is accurate, complete or up-to-date.
- WE ARE NOT RESPONSIBLE FOR WEBSITES WE LINK TO
- Our Website, the Surveys and communications relating to the Panel may contain links to third-party websites. We are not responsible for the content, or accuracy of the content, on these links, and we are not responsible for or liable to you for any errors or inaccuracies in the content of these links. If you are not happy with something relating to these third-party websites, you should contact the operator of that website directly. We have no control over the contents of those sites or resources.
- THIRD PARTY ADVERTISING, PROMOTIONS AND COMPETITIONS
- The Website, the Surveys and communications relating to the Panel may contain advertising. Each individual advertiser is solely responsible for the content of its advertising material. We accept no responsibility for the content of advertising material, including, without limitation, any error, omission or inaccuracy in that advertising material.
- You may be able to access competitions and promotions operated by third parties via our Website. You should check and comply with the rules of each individual competition. We will not have any liability in connection with any claims, complaints, proceedings or disputes relating to competitions or promotions run by third parties.
- JURISDICTION AND GOVERNING LAW
- These Terms shall be governed by and construed in accordance with laws of England & Wales. However, if you are a consumer, these Terms will not limit any consumer protection rights that you may be entitled to under the mandatory laws of your country of residence.
- Any disagreement or dispute that is unable to be resolved amicably shall be referred exclusively to the courts of England and Wales, save that if you are a consumer and you do not live in the UK you can bring a claim in the courts of your territory of residence.
